EPA states under AHERA that “In 1986, the Asbestos Hazard Emergency Response Act (AHERA) was signed into law, requiring public and private non-profit primary and secondary schools to inspect their buildings for asbestos-containing building materials”

But does not apply to your University as it does not fall under the K-12 category unless you rent out or let a K-12 use one of your rooms/building, then that room or building becomes an AHERA facility.

Even though UW Stout is not an AHERA facilitity it is still goverened by all allplicable NESHAP and OSHA rules regarding asbestos.

AHERA applies to all public and private FOR PROFFIT K-12 schools.
